ACCEPTANCE OF TERMS

beBetter Health®, a division of Ebix, Inc. ("beBetter Health," "Ebix," "we," "us," or "our"), provides access to its website(s), mobile application(s), wellness platforms, and related services (collectively, the "Platform").

These Terms & Conditions of Use ("Terms") govern your access to and use of the Platform.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree you must not use the Platform.

We may modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

ELIGIBILITY

The Platform is intended solely for individuals 18 years of age or older. It is not designed for or directed to minors.

You represent and warrant that:

  • You are at least 18 years old; and
  • You are authorized to use the Platform, including through an employer, health plan, or partner organization, where applicable.

DESCRIPTION OF SERVICES

beBetter Health provides digital health and wellness services, which may include:

  • Wellness programs and educational webinars
  • Health coaching services
  • Health risk assessments (HRAs)
  • Participation tracking and incentive reporting
  • Integration with wearable devices and third-party health tools
  • Biometric screening coordination through third-party partners
  • Storage, aggregation, and reporting of health-related data

Services may be offered through employers, health plans, or other sponsoring organizations.

PERMITTED USE

You may use the Platform solely for personal, non-commercial use in connection with your participation in a wellness or health program.

PROHIBITED ACTIVITIES

You agree not to:

  • Violate any applicable laws, regulations, or contractual obligations
  • Attempt to gain unauthorized access to systems or data
  • Use automated tools to scrape, extract, or monitor content
  • Upload malicious code (viruses, malware, etc.)
  • Misrepresent your identity or eligibility
  • Interfere with the operation or security of the Platform
  • Copy, modify, distribute, or reverse engineer any part of the Platform

INTELLECTUAL PROPERTY

All content on the Platform—including text, graphics, software, logos, and program materials—is owned by or licensed to Ebix and protected under applicable intellectual property laws.

You may not:

  • Copy, reproduce, or distribute content
  • Create derivative works
  • Use trademarks or branding without prior written consent

PRIVACY AND HEALTH INFORMATION

Your use of the Platform is also governed by our Privacy Policy, available at: https://bebetterhealth.net/Privacy.aspx

Protected Health Information (PHI)

We may collect, store, and process health-related information that may constitute Protected Health Information (PHI) under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA").

Where applicable:

  • We act as a business associate to employer-sponsored health plans
  • PHI is handled in accordance with HIPAA and applicable agreements

Your data may also be shared with:

  • Your employer or health plan (in aggregated or permitted formats)
  • Third-party service providers (e.g., biometric screening vendors, device integrations)

All content and services—including coaching, assessments, and educational materials—are for informational and wellness purposes only.

They are not intended to:

  • Substitute for professional medical advice

Always consult your physician or qualified healthcare provider regarding any medical condition.

Do not disregard professional medical advice or delay seeking care because of information obtained through the Platform.

DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EBIX DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT OR DATA

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Accuracy of health data from third-party sources

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

EBIX AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION

ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

This applies even if we have been advised of the possibility of such damages.

INDEMNIFICATION

You agree to indemnify and hold harmless Ebix, its officers, directors, employees, and partners from any claims or damages arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your misuse of health-related data

SUSPENSION OR TERMINATION

We reserve the right to suspend or terminate access to the Platform at any time if:

  • You violate these Terms
  • Your eligibility through a sponsoring organization ends
  • Required by law or contractual obligations

GOVERNING LAW

These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

Any disputes shall be resolved in the state or federal courts located in Georgia.

SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
